Most attorneys agree there are some defensible tactics that are used in any DUI case. The most prominent is the "Rising level of Alcohol" in the blood stream from the time of the last drink to the time of the offense and then the time of the first and last sobriety test.

I have investigated several cases involving crucial time lines that have assisted in winning trial cases. For example: One case involved DUI with vehicular manslaughter charges. The defense of this case cleared the client off completely at a jury trial. The statement of the waitress that served the client drinks at the club was part of the case breaking evidence to win the case.

Other supportive evidence involved researching traffic signs, road conditions, city postings and contacting the person most knowledgeable in the County Transportation Department, are all important elements in our clients defense.

Locating witnesses that moved and finding receipts from the clients transactions that entire evening prior to the event was also necessary for the attorney to present the case in the most factual and evidential way. Sending the charged to a 12-step program is a good start.
